Clause 1

Definitions

Company means Tailor Made Joinery Pty Ltd ABN 27 695 729 634.

Customer means any individual, builder, company, developer or entity purchasing goods or services from the Company.

Goods includes cabinetry, joinery products, flatpacks, hardware and related materials supplied by the Company.

Services includes design, manufacture, supply, delivery and installation of joinery products.


Clause 2

Acceptance of Terms

Acceptance of a quotation, payment of deposit, digital approval, email confirmation or instruction to proceed constitutes acceptance of these Terms & Conditions.


Clause 3

Quotations

All quotations:

  • are valid for 14 days
  • are based on information supplied by the Customer
  • may change where scope, measurements or specifications change.

Unless otherwise specified in writing, quotations exclude:

  • plumbing works
  • electrical works
  • structural works
  • plastering, tiling or painting
  • building permits
  • demolition or removal of existing cabinetry or joinery
  • site preparation or rectification works.

Where demolition of existing joinery is required this may be quoted separately.


Clause 4

Price Estimates & Rise and Fall

All quotations are estimates based on supplier pricing at the time of quotation.

Tailor Made Joinery Pty Ltd reserves the right to apply rise and fall adjustments where supplier costs, freight costs, material pricing or project scope changes.


Clause 5

Payment Terms

Unless otherwise agreed in writing the following payment schedule applies.

Stage Milestone
10% Job Booking Fee
A 10% non-refundable booking fee secures the project within the production schedule. No design work, layouts, drawings or shop drawings will commence until received.
40% Material Ordering / Pre-Production
Required prior to ordering materials and commencing pre-production.
40% Pre-Installation Payment
Required prior to delivery or installation. Goods will not be delivered until 90% of the contract value has been paid.
10% Final Payment
The remaining balance is payable upon practical completion.

Invoices are payable within 7 days unless otherwise agreed.

Late payments may incur interest not exceeding the ATO General Interest Charge (GIC).


Clause 6

Combined Payment Claims

The Company may combine deposit and pre-production claims into a single invoice where required to secure production scheduling and order materials.


Clause 7

Material Supply

Materials required for manufacturing may take up to 3 weeks to arrive at the Company's factory from supplier order, depending on supplier availability.

Production lead times commence once materials have been received.

Materials ordered for projects are generally paid for upfront by the Company to suppliers.

Where an order is cancelled after materials have been ordered, the Customer may be liable for:

  • supplier restocking fees
  • non-returnable material costs
  • freight or handling charges
  • administrative costs associated with cancellation.

These costs may be charged in addition to the cancellation fee outlined in Clause 16.

Where materials are non-returnable or custom ordered, the Customer may be required to pay the full cost of those materials.


Clause 8

Manufacturing Lead Times

Joinery products are custom manufactured.

Typical production lead time is up to 8 weeks from:

  • deposit received
  • final measurements
  • approved shop drawings.

Clause 9

Shop Drawings & Client Approval

The Company may require signed shop drawings prior to manufacturing.

Approval confirms cabinet layouts, dimensions, materials, finishes and hardware selections.

Changes after approval will be treated as variations.


Clause 10

Variations

Changes requested after quotation acceptance may result in:

  • additional costs
  • revised production timelines.

Clause 11

Site Access & Readiness

The Customer must ensure the site is safe, accessible and ready for installation.


Clause 12

Demobilisation & Remobilisation Fees

Where installation, delivery or site works are scheduled and the site is not ready, inaccessible or unsafe, Tailor Made Joinery Pty Ltd reserves the right to charge a demobilisation fee covering labour, travel and scheduling disruption.

Where works must be rescheduled and the Company must return to site, a remobilisation fee may apply.


Clause 13

Storage Fees

Where goods have been manufactured but installation is delayed, the Company may charge:

  • storage fees
  • re-delivery costs
  • re-scheduling fees.

Clause 14

Design Services

Tailor Made Joinery Pty Ltd may provide design services including layouts, drawings and material selections.

No design work will be undertaken until the 10% booking fee has been paid.

Reasonable design revisions may be included within the quoted scope.

Where excessive redesigns are requested the Company may charge additional design fees.

All drawings remain the intellectual property of Tailor Made Joinery Pty Ltd.


Clause 15

Refunds, Returns & Exchanges

Due to the custom nature of joinery products the Company does not provide refunds, returns or exchanges for incorrect measurements or change of mind.

Nothing in this clause excludes rights under the Australian Consumer Law.


Clause 16

Order Cancellations

Where an order is cancelled after acceptance of a quotation the Company may charge a cancellation fee equal to 20% of the total job value.

This fee excludes design hours and site measure costs which will be charged separately.

Refunds may take up to 10 business days to process.


Clause 17

Tailor Made Flatpacks (TMF)

Tailor Made Flatpacks operates as a custom joinery cut service.

All flatpack orders require full payment upfront prior to production.

Production begins once payment is received and shop drawings approved.


Clause 18

Price Beat & Price Match Policy

Tailor Made Flatpacks offers a 10% Price Beat Guarantee on written quotes from Bunnings or IKEA for comparable flatpack cabinetry products on a like-for-like basis.

For other competitors, Tailor Made Flatpacks and Tailor Made Joinery may offer a price match only.

Competitor quotes must be located within 100km of the Company office and within 50km of the nominated pickup depot unless otherwise approved.

The Company reserves the right to verify pricing and decline claims where products are not comparable.


Clause 19

Practical Completion & Minor Defects

Practical completion occurs when works are substantially complete.

Minor defects do not allow withholding of payment.

Where other trades commence work involving the joinery, practical completion will be deemed to have occurred.


Clause 20

Site Handover & Risk Transfer

Upon completion of installation the risk transfers to the Customer or site controller.

The Company is not responsible for damage caused by other trades after installation.


Clause 21

Warranty

Tailor Made Joinery Pty Ltd provides:

  • 10-year warranty for residential cabinetry
  • 12-month warranty for commercial installations
  • 12-month warranty for Tailor Made Flatpacks (TMF).

Hardware and fittings may also be covered by manufacturer warranties.

This warranty may be void or limited where joinery has been:

  • altered or modified by third parties
  • interfered with by other contractors
  • damaged by other trades
  • exposed to excessive moisture or water damage
  • subjected to misuse, abuse or improper use.

Examples of misuse include:

  • standing or climbing on cabinetry
  • overloading drawers or shelves
  • hanging excessive weight on doors or hinges
  • slamming doors or drawers
  • storing water or wet materials inside cabinets.

Due to the nature of timber-based and manufactured board products used in cabinetry, minor movement, bowing, warping or deflection may occur over time, particularly in:

  • large cabinet doors
  • tall pantry doors
  • wide drawer fronts
  • long shelving spans.

Such movement may occur due to environmental conditions including humidity, temperature changes, building movement or loading of shelves.

Minor bowing or deflection within acceptable industry tolerances does not constitute a defect and is not covered under warranty.


Clause 22

Care & Maintenance

Customers should clean surfaces with mild detergent and avoid abrasive cleaners or excessive moisture.

Failure to follow care guidelines may affect warranty coverage.


Clause 23

Ownership of Goods

All goods remain the property of Tailor Made Joinery Pty Ltd until full payment has been received.


Clause 24

PPSR Security Interest

The Company may register a security interest under the Personal Property Securities Act 2009 (Cth) over supplied goods.


Clause 25

Debt Recovery

All legal, collection and enforcement costs incurred recovering debts may be added to the Customer's account.


Clause 26

Client Delays & Abandoned Projects

Where a Customer delays the project for more than 30 days, the Company may charge storage or administration costs and treat the project as suspended.


Clause 27

Privacy

Customer information may be stored within company systems including CRM and quoting software.


Clause 28

Intellectual Property

All drawings and designs remain the intellectual property of Tailor Made Joinery Pty Ltd.


Clause 29

Indemnity

The Customer indemnifies the Company against claims arising from incorrect measurements or unsafe site conditions.


Clause 30

Photography & Marketing Rights

The Company may photograph completed projects for marketing purposes including websites and social media.


Clause 31

Force Majeure

The Company will not be liable for delays caused by events beyond its control including supplier shortages, freight disruptions or natural disasters.


Clause 32

Governing Law

These Terms are governed by the laws of Victoria, Australia.
